RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS

PLEASE READ CAREFULLY: THIS IS A LEGALLY ENFORCEABLE WAIVER OF RIGHTS  

ASSUMPTION OF RISKS  

I acknowledge that I have voluntarily applied to participate in the event designated above. I am voluntarily participating in the event with knowledge that travel involves numerous risks and dangers including, but not limited to, a risk of illness, injury or death, which may be caused by: forces of nature, civil unrest, terrorism, road conditions, injuries inflicted by animals, insects, reptiles or plants, trails, hotels, vehicles, boats or other means of conveyance; high altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; and the lack of adequacy of medical attention once provided. I assume the risk of negligence on the part of Her World presented by Powerful Steps & ReLaunch, their affiliated organizations and their employees, teachers, volunteers or other agencies in connection with said event.  

I HEREBY ACCEPT ANY AND ALL RISKS OF ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH AND VERIFY THIS STATEMENT BY PURCHASING MY TICKET.

RELEASE

AS LAWFUL CONSIDERATION for being permitted by Her World presented by Powerful Steps & ReLaunch, to participate in such event and accompanying activities, I hereby agree that I, my heirs, legal representatives or any member of my family will not make a claim against or sue Her World presented by Powerful Steps & ReLaunch, or any of their affiliated agents, employees, teachers or volunteers, for bodily injury, death, emotional trauma or property damage resulting from my participation in the event.  

Powerful Steps & ReLaunch shall not be liable, directly or indirectly, for bodily injury or property damage for any reason whatsoever, including, but not limited to the following causes: acts of God, pandemics, epidemics, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft, negligence including negligence of Powerful Steps & ReLaunch, default, changes in government regulations, terrorism, war or failure of conveyance to arrive or depart as scheduled.  

I therefore release and discharge Powerful Steps & ReLaunch, and their agents, employees, teachers and volunteers from and against any and all liability arising from my participation in the event even though that liability may arise out of negligence or carelessness on the part of Powerful Steps & ReLaunch, or their affiliate agents, employees, teachers or volunteers.  

If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Under no circumstances shall Powerful Steps & ReLaunch be liable to any event participant for more than the land cost of the event applied for on this document. I waive any charge-back rights and, in the event of dispute, requests for a refund will be made using the procedures described under the “Cancellation and Refunds” section below. All applications are subject to acceptance by Powerful Steps & ReLaunch. Upon acceptance of my application, this agreement shall be construed according to the laws of the United States. In the unlikely event a legal dispute should arise involving any subject matter whatsoever, I agree that the exclusive venue for any legal action shall be the United States.

  I HEREBY ACCEPT THE ABOVE THREE PARAGRAPHS AND VERIFY THIS STATEMENT BY PLACING MY ORDER FOR A TICKET.

CANCELLATION

For cancellation requests, we have a pay-it-forward policy in place. This means if you are unable to attend, advise us in writing and your ticket can be gifted to a lucky lady on the waitlist. No refunds will be issued under any circumstances.  

Powerful Steps & ReLaunch reserves the right to cancel any event prior to departure for any reason whatsoever, including an insufficient number of participants or logistical problems, which may impede event operations. The refund of all payments as described in the paragraph below shall release Powerful Steps & ReLaunch from any further liability. An event trip cancellation due to insufficient numbers would normally occur at least a month prior to departure, unless acts of God, war, strikes or other events impede our departure causing large numbers of participants opt to cancel participation on the journey in the last days before departure.  

Powerful Steps & ReLaunch must make substantial payments to suppliers (including providers of land travel) far in advance of the scheduled date on the event. If the event is cancelled due to forces beyond our control (acts of God, war, labor strikes, earthquake, flooding, etc.), Powerful Steps & ReLaunch will promptly refund the portion of the event cost not advanced to suppliers, team members or other expenses incurred. Powerful Steps & ReLaunch will use its best efforts to recover advance payments as promptly as possible, and will refund to you the pro-rated amount recovered, if any. However, Powerful Steps & ReLaunch does not guarantee recovery of any or all of the advance payments made.  

Force Majeure. No Party shall be liable or responsible to the other Party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make previously owed payments to the other Party hereunder) when and to the extent such failure or delay is caused by or results from acts beyond the impacted Party’s (“Impacted Party”) reasonable control, including, without limitation, the following force majeure events (“Force Majeure Event(s)”) that frustrates the purpose of this Agreement: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) epidemic, pandemic or similar influenza or bacterial infection (which is defined by the United States Center for Disease Control as virulent human influenza or infection that may cause global outbreak, or pandemic, or serious illness); (j) emergency state; (k) shortage of adequate medical supplies and equipment; (l) shortage of    

KNOWING AND VOLUNTARY EXECUTION  

I have carefully read and fully understand the contents of this agreement. I am aware, that this is a release of liability and a legally binding and enforceable contract between myself and Powerful Steps & ReLaunch that I agree to when I purchase my ticket.
